The Site Constitution



Chapter I, Foundation of Consitution,
Article 1,
The staff of the Avatar RPG join together and establish this
Constitution in our united beliefs of equality among all members, freedom from all
forms of exploitation and oppression, the necessity of democracy,
justice, and the protection of all natural rights belonging to the members, moderators, administrators, and thereof.

Chapter II, The General Council of Members' and Role-Players' Deputies,
Article 2,

The Avatar RPG Staff hereby establishes the General Congress of Members' and Role-Players' Deputies, known simply as the Council. The
Council is the ultimate authority and legislative power of the Avatar RPG, the Council is also known as the Staff members of the site. The Council is made up of a minimal 8 starting people, and there-after elected people if one of the original 8 choose to quit or give up their position.
A Council member may only be expelled from their position if it is agreed upon by the majority of the site in a poll.

Article 3,
The Council has the power to create new legislation, modify past
legislation, and amend and change the Constitution if all members
within council agree to do so with the permission of a majority of the members' consent which is tallied in a poll posted on the site.

Article 4, The
General Congress may not be dissolved or have its executive powers
overridden or denied as long as their decisions are backed by the majority of the members, if a second poll is taken after a minimum of one week, if the members all agree that their decision is wrong, the decision will be changed accordingly. All powers not restricted or moderated by the
Constitution are reserved by the Council.

Chapter III, Legislation,
Article 5,
General legislation will require a simple majority approval of over 50%
of members of the site in order to carry into law. Legislation intended to amend
the Constitution or decide upon matters of foreign sites, such as affiliations, will require 65% majority in order to be enacted.

Chapter IV, Central Committee,
Article 6,

To moderate the Avatar RPG and the Council and to keep the site orderly, the Avatar RPG hereby establishes the
Central Committee to act as the site's sub-government. The Central Committee
consists of a Commissar of Foreign Affairs, a Commissar of Application Administration, a Commissar of Recruitment and Education, and a Commissar of Law Enforcement
Central Committee: CoFA, CoAA, CoRE, and CoLE.

Article 7,
The Commissar of Foreign Affairs is charged with the duties of
organizing our current relationships with other alliances, including
negotiating affiliations, representing the Avatar RPG to other sites, and to ensure that the site prospers from a diplomatic
viewpoint.

Article 8, The Commissar of Application Administration is charged with the duties of organizing and approving applications, although all council members may approve or deny an application, the Commissar of Application Administration may over-rule any approval, something that no other council member may do, and can also add on to the character template, as long as it does not face opposition against the majority of the site, and their views.

Article 9,
The Commissar of Recruitment and Education is charged with the duties
of producing an adequate recruitment program to ensure a steady flow of
new members to the site, creating guides to educate new members of the site on the site mechanics of Role-Playing as well as the show: Avatar, ensuring that new members
understand the various positions and roles of the site, and working
to ensure that the site prospers in education and recruitment.

Article 10,
The Commissar of Law Enforcement is the head of banning among the Avatar RPG.
He or she will be elected by the members of the Avatar RPG.
The appointment may not be over-ruled by anyone or any power, unless the elected person chooses to become inactive, becomes inactive, or does his job poorly. The decision on whether or not this is true, will be judged by a minimum of 5 complaints and after that there will be a second poll to either keep the current CoLE or to elect a new one.
The CoLE is to organize the members that are banned, come up with plans on punshiment to those who break rules, and to make sure the rules are followed. The CoLE is allowed to over-ride a ban, un-ban, but not a kick or warning. They are also in charge of unbanning at the right time and keeping track of such information.

Article 11,
All offices are to undergo a monthly election. The electoral process
will begin with a three-day long nomination process, followed by a four-day (sometimes shorter or longer) long electoral process. At the end of the elections, the
winners will be sworn in. The elections will be conducted by poll.

Article 12, Should, for any reason, a Commissar position not be fulfilled, an emergency election will be held for a new Commissar.

Article 13,
The Central Committee may appoint Deputies to handle specific tasks
within the alliance. Any appointments may be vetoed by the council as a whole.

Chapter V, Spaming, Flaming, and Raiding Other Sites,

Article 16,

The Avatar RPG gives its members the freedom to spam or raid other sites with messages or hacking, so long as the site is not an affiliate and does not possess any more than 150 members, and you must also get permission from the CoLE who will conduct a poll among the council members on whether you may, or not. If you do not possess the permission to do so, the punishment is a ban for six months. This punishment may not be changed or influenced by the CoLE.

Chapter VI, Staff Ranking,
Article 17, If a higher ranking council/staff member disagrees with a decision of a lower ranking council/staff member, the lower ranking staff member's decision will be over-ruled unless they are a Commissar of that specific topic, or the constitution or bill of rights forbids it.

Article 18, The General of the Site is the only highest power of the entire site. The General of the Site may over-rule any decision made by any member of council or commissar, unless the entire rest of the council disagrees with the General of the Site's veto/over-ruling. The General of the Site may also make any decision he or she pleases as long as it does not enter the territory of the four commissars unless he or she is a commissar themselves. However, the members of the site still have the right to majority over-rule his or her decision.

Article 19, If the majority of the site's members agree that a council/staff member is over or under ranked, they may request a poll to be done to choose their new position. If requested by a majority of the site, the poll must be made and votes tallied.

Bill of Rights:



Democracy
The Avatar RPG Government is a democracy led by the Council where the members vote to make decisions and run the site. We have elected leaders who help manage the site and act as public leaders but all power is held by the people, and their decisions on how the site is ran.

Freedom of Speech
All members of the Avatar RPG Community are guaranteed free speech in all its forms. Whether it is public or in the privacy of our forums you, will not be persecuted for speaking your mind against the leadership, fellow members, or foreign sites provided the criticism is valid and thoughtful and not just insults. New ideas and radical opinions are respected and encouraged, not attacked.

Freedom of Religion
All members of the Avatar RPG Community are guaranteed the freedom to practice and converse about their own religion, as long as it does not constitute heinous or hateful content. Whether it is public or in the privacy of our forums, you will not be persecuted for your religion or beliefs. If another member is persecuting you because of your religion, or making a joke of your religion, report it to the CoLE, and he or she will bring it before council for a discussion on what the punishment, if any at all, will be.

Right to a Fair Trial
Whomever is accused of an act upon the site Avatar RPG, including treason, will have the right to a fair trial. The trial will consist of a jury, namely the council and an equal amount of regular members of the site. The General of the Site will act as judge of the trial to keep things orderly. The defense may hire a lawyer on their behalf, and the prosecutor (the CoLE in a government or community affair) will bring witnesses and proof to the attention of the jury. The jury will then vote. Majority rules, meaning if most of the jury agrees the defense is innocent, all charges will be dropped, if most of the jury agree that the defense is guilty, he will face charges decided upon by the CoLE, determined by the severity of the crime or if the law already had an official punishment, that will be enacted. The punishment may not be adapted by the CoLE at the time of someone's trial or within half an hour after, or after the crime itself is committed, if the punishment trying to be changed corresponds with the crime committed.

Protection
Once a member of the Avatar RPG Community, you are guaranteed protection from all harassers and flamers. Should your person be unduly attacked, your fellow members will step in and try to help in whatever way possible. This provides a safe environment in which you can communicate and RP without others interrupting your right to pursue happiness.

Guidance
New members with little experience or understanding of Role-Playing are welcomed. We will do everything we can as a site to teach and guide you to Role-Play and participate in the site politics.

Equality
All members of the Avatar RPG Community, are considered equal in every way. No one shall be treated better than another. Treat everyone with the respect that you would treat your best friend with, as well as the respect you would like to be given yourself.

An official poll will be posted tomorrow on whether or not this constituion, accompanied by the bill of rights, will be enacted. If any modifications seen fit by the members would be liked, please post so here.
